Terms & Conditions
The contract is for the hire of goods detailed in the contract and the parties to the contract are:
The person, firm, company or other organisation hiring the equipment (Hirer).
Hudson Scaffolding Limited – Fox Hollow, Old Reigate Road, Betchworth, Surrey RH3 7DE.
The Contract is effective when Hudson Scaffolding Ltd. accepts the Hirer’s order.
Hudson Scaffolding Ltd. May terminate the Contract and repossess Equipment without affecting any rights to recover monies due, damages for breach of contract, where the Hirer is involved in insolvency or liquidation proceedings.
At all times equipment hired remains the property of Hudson Scaffolding Services Ltd.
The Hire charges are for the duration of the contract and include weekends and Public Holidays.
Delivery and collections, including attempted calls, are chargeable.
The Hirer will pay for breakages and damage repair, and notify Hudson Scaffolding Ltd. immediately of all loss or damage to equipment.
In the event of damage to sheeting/netting due to wind conditions a repair/renewal charge will be made.
The Hirer undertakes to accept full responsibility for loss or damage to equipment from whatever cause. Hudson Scaffolding Ltd. will treat equipment unavailable for collection from site, or un-returned after being off hired by the hirer (after reasonable notice), as lost and the Hirer will pay a charge for equipment replacement and revenue loss. Hire charges accrue until full settlement is made.
The hirer should inspect the equipment and notify Hudson Scaffolding Ltd. immediately of any defect.
The hirer accepts responsibility for equipment security until its collection or return to Hudson Scaffolding Ltd, and undertakes not to sell or relinquish possession, alter, repair or modify it in any way.
The hirer shall not lend, sell, mortgage, or part with possession of the equipment. The hirer shall protect against distress, execution or seizure and shall indemnify Hudson Scaffolding Ltd. of all charges and expenses by failure to observe this condition.
The Hirer is responsible for the safe use and correct operation of equipment by competent persons.
The Hirer will immediately notify Hudson Scaffolding Ltd. of any equipment defect, breakdown or shortcoming without attempting to rectify, alter or repair.
The hirer will ensure any non-Hudson Scaffolding Ltd. equipment used in conjunction with, or attached to, equipment also conforms to safety requirements.
The Hirer will ensure that any materials attached to or put on to the equipment are within the correct loading limitations.
The hirer will indemnify Hudson Scaffolding Limited in respect of all claims by any person for injury to persons or property caused by equipment whether arising under statute or common law.
The Hirer remains responsible for the equipment, and in particular its security, until return or collection. The Hirer agrees to insure equipment on a full replacement basis against the risks of loss, theft, and damage beyond economic repair and pay to Hudson Scaffolding Ltd. any insurance claim proceeds. This liability is without prejudice to any Hudson Scaffolding Ltd. rights under the contract.
